i have made a note with call 4bet effective stack 80 to 1000 bb

is there anyway i can make not count a hand like this where villain has a small stack

You could try to work around it a little - you could add two filters for Opponent:
(1) 4Bet Preflop
and
(2) Preflop Effective Stack Size 80 to 1000 BB

This will guarantee that whoever made the 4bet is also at least as deep as the player getting the note. That should rule out the exact case you give and most other situations like it you would want to avoid I think.
