That's because your note definition is incomplete. All you say in the Opponent section is that Player Is Hero. And that is true here - someone did 3bet preflop out of position with an opponent who is hero.

If you want to only include hands where Hero was involved in the action you need to be more specific in the Opponent section - for example Player is Hero AND Raise Preflop Any Raise would ensure that hero made some preflop raise.

another question:

how can I check "in posi" etc preflop? as u see at my notetracker rule i filter flop "in position".

In position on flop will actually probably work the best for you - for almost all notes you might want to take the hand will need to hit the flop anyway.
